Note On State Statutes Re: Self Storage Business
Most states have passed statutes governing various aspects of the self storage business. These statutes typically outline that self storage is not the same as "warehousing" in that self storage involves renting space while warehousing is exercising "care, custody and control" over goods. These state self storage laws also typically outline the steps that must be taken before a self storage business may sell or auction stored goods to satisfy obligations for unpaid rent. These provision typically require notice by certified mail, newspaper publications or both.
If you are a tenant in a storage facility, remember that most facility owners don't want to sell stored contents - they simply must get paid and get the space rented to someone that can timely pay rent. Offer to pay part of the rent due and move out, and agree to pay the balance over time. Most storage facility owners will work an arrangement with you, but remember, they are not required to do so.
